What are landlords allowed to deduct from a security deposit in New York?

Landlords in New York may deduct for damage beyond normal wear and tear, unpaid rent, and excessive dirt or filth requiring deep cleaning. They cannot deduct for ordinary aging, small scuffs, or routine turnover cleaning.

How clean does my apartment need to be when I move out in New York?

While the legal requirement is 'broom-clean condition,' most landlords expect the unit returned in move-in-ready condition. This includes a deep cleaning of kitchens, bathrooms, appliances, floors, cabinets, and all surfaces.

What is considered normal wear and tear in New York?

Normal wear and tear includes things like minor wall scuffs, faded paint, worn carpet, loose knobs, or light surface wear. These items cannot be deducted from a security deposit under New York law.

How long does a landlord have to return a security deposit in New York?

Under New York's HSTPA law, landlords must return the deposit within 14 days of move-out. If deductions are taken, they must provide an itemized list with receipts or reasonable estimates.

Should I hire a professional move-out cleaning service in New York?

Professional move-out cleaning significantly reduces the chance of deposit deductions. Cleaners ensure the unit meets landlord expectations for move-in-ready condition, including deep cleaning appliances, bathrooms, floors, cabinets, and high-use areas.

When should I schedule a move-out cleaning?

The best time to schedule a move-out cleaning is the same day you return the keys or the day before your final inspection. This prevents dust and dirt from accumulating after furniture removal.

Can a landlord charge me for routine cleaning in New York?

No. Landlords cannot charge tenants for routine, expected cleaning such as dusting, vacuuming, or general turnover work. They may only charge for excessive filth or neglect that requires additional labor beyond normal cleaning.
